The following General Terms and Conditions apply exclusively to the relationship between feratel and the user.
If purchases/bookings/etc. are made via one of our partners (e.g. region, TVB), the terms and conditions valid in the partner program shall apply and feratel shall neither become a contractual partner of these legal relationships nor shall it assume any liability for any damages, claims, etc. arising from these areas.
The content of this platform is created and maintained editorially by feratel in collaboration with the cooperation partners. The content is protected by copyright. All content (information, data, images, graphics, etc.) is intended solely for the information of users. Any other use and exploitation of the content is expressly excluded, in particular any other distribution, modification, duplication, public provision or editing.
Although the contents and data of the platform are created by feratel with the greatest possible care and to the best of its knowledge and belief in close cooperation with the cooperation partners, feratel cannot guarantee the completeness, up-to-dateness or accuracy of all data and assumes no liability for this. Compensation for consequential damage and financial loss, loss of profit, unrealized savings, loss of interest, lost or altered data, non-material damage and damage arising from third-party claims is excluded. feratel shall not be liable for claims that may arise from any operational disruptions (e.g. mutilation, omissions or delays). Liability for slight negligence is excluded. This applies in particular to data such as snow values, weather, etc.).
Since a large amount of content such as accommodation descriptions, event information, ski resort descriptions, tour descriptions and other descriptions of infrastructure facilities and leisure tips are created and taken over by third parties, it is naturally not possible for feratel to check the large amount of this information. For this reason, feratel assumes no liability or guarantee whatsoever for the accuracy, timeliness, correctness, completeness and permissibility of the third-party content presented on its platform.
Furthermore, users are expressly requested to comply with the relevant legal regulations when carrying out their leisure activities, to adapt the selection and execution of the chosen leisure activity to their personal capabilities, to carry out the risk assessment on their own responsibility and to act in a risk-conscious and responsible manner.
In the B2C (Business to Consumer) area, all prices are quoted in euros (€) and include statutory VAT. In the B2B (Business to Business) area, all prices are quoted in euros (€) exclusive of statutory VAT. All fees and taxes (in particular VAT) are calculated on the basis of the applicable legal situation.
The contractual relationship shall be governed exclusively by Austrian law. The place of jurisdiction for any disputes arising from this contract shall be the competent court in Innsbruck.
The invalidity or unenforceability of individual provisions of the contract shall not affect the validity and enforceability of the previous provisions. In such a case, the contracting parties are obliged to endeavor to replace the invalid or unenforceable provision with a valid and enforceable provision that comes as close as possible to the economic purpose of the invalid or unenforceable provision.
